1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of downtownchicagofoodie.com (the “Site”) and any subscription services offered by Downtown
Chicago Foodie Group (“DCFG,” “we,” “us,” or “our”). By accessing the Site or purchasing a subscription, you agree to be bound by these Terms.
2. Description of Services
DCFG provides trade-exclusive competitive analysis, restaurant category lists, neighborhood crime data, and related commentary for the restaurant and hospitality
trade in downtown Chicago. Subscriptions are available on an Individual or Group basis, as described on the Subscription page.
3. Eligibility
Subscriptions are intended for restaurant owners, operators, hospitality groups, investors, real estate developers, and others in the restaurant trade. DCFG’s
analysis is not available to the general public, restaurant critics, review services, Substack, or individual newsletters.
4. Subscription Terms & Payment
- Individual subscriptions are $5,000 per year; Group subscriptions are $7,500 per year, as described on the Subscription page
- Payments are processed through Stripe or by mailed check, as instructed at checkout
- Subscriptions may be cancelled at any time; however, annual refunds are not available once distribution of content has started for that subscription period
- Promotional terms (such as limited-time group subscription allowances) are time-boxed and may change without notice once the promotional period ends
5. Intellectual Property & Use Restrictions
be copied, screenshotted, forwarded, or redistributed in any form without DCFG’s express written permission. Sample analysis and sample restaurant list materials
made freely available on the Site may be shared without restriction.
6. Accuracy of Information
DCFG’s analysis is drawn from multiple sources believed to be reliable, including official government and law enforcement data. However, DCFG cannot guarantee
the accuracy, completeness, or timeliness of any information provided, and such information may change without notice. Content is provided “as is” for
informational purposes and should not be treated as a guarantee of any outcome.
7. No Advertising
DCFG does not accept advertising and its analysis is not influenced by any restaurant, hospitality group, or third party appearing within it.
8. Limitation of Liability
To the fullest extent permitted by law, DCFG shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on
any content provided, including but not limited to business decisions made based on DCFG’s analysis.
9. Third-Party Services
The Site uses third-party services, including Stripe for payment processing and Mailchimp for email communications. Your use of those services is subject to their
respective terms and privacy policies.
10. Termination
DCFG reserves the right to suspend or terminate access to its services for any subscriber who violates these Terms, including unauthorized redistribution of
subscription content.
11. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal
courts located in Illinois.
12. Changes to These Terms
DCFG may update these Terms from time to time. Continued use of the Site or an active subscription after changes are posted constitutes acceptance of the revised
Terms.
